English

Ordoliberalism, as one of the prominent movements in twentieth-century German economics, emerged in response to the crises of laissez-faire liberalism and the inefficiencies of extensive state intervention, seeking to provide a model for market economic governance. Its central problem was how to establish an economic order that, while preserving freedom and competition, prevents the concentration of economic power and state interventionism. The present study aims to elucidate the market governance model in ordoliberalism and analyze the transition from classical liberalism to social order. The research methodology is a systematic critical rereading based on the study of Walter Eucken’s works and contemporary commentators of this tradition. The findings indicate that ordoliberalism, by distinguishing between “order policy” (Ordnungspolitik) and “process policy” (Prozeßpolitik), shifts the role of the state from direct intervention to the creation and preservation of legal and institutional frameworks for competition. In this framework, the competitive market is not a spontaneous phenomenon, but rather the product of constitutive and regulative principles aimed at guaranteeing competition, curbing monopoly, ensuring policy stability, and limiting private and public economic power. Thus, the model of market governance in ordoliberalism represents an endeavor to strike a balance between economic freedom, the rule of law, and social justice, representing a significant theoretical transition from classical liberalism to a competitive social order.
